Orlando, Fla. — The Fresh Market was first but now even Disney is asking customers to wear masks or go home.
Florida law states that business owners can enforce mask wearing policies, if they choose, the same way they enforce the no shirt, no shoes policy.
In Florida, a business can always refuse service and lawyers Jillian de Chavez-Lau and Joshua A. Stein wrote in The National Law Review that as long as the guidelines suggest masks as a precaution, it's allowed.
Keep in mind though, that with no mask law on the book, there's really no penalty for not wearing one, all a business can do is ask someone to leave.
So far, we have not heard of a customer who has been turned away for not wearing a mask but the latest guidelines from the Centers for Disease Control and Prevention recommend wearing face coverings as the first defense of blocking the virus in public settings where social distancing is hard to achieve .
