Woman sues Jimmy John's for forgetting the sprouts on her sandwich

(Josh McCarthy)

A California woman has filed a lawsuit against sandwich restaurant Jimmy John's, claiming that she ordered a sandwich with sprouts and they didn't put sprouts on it.

The woman, Heather Starks, filed the suit in Los Angeles Couty, CA, claiming “that she purchased sandwiches advertised in online and in-store menus, among other places, as including sprouts, which did not in fact include sprouts.”

Starks is claiming listing fraud and a violation of California's False Advertising Act, among other claims.

Even though Jimmy Johns denies Starks' claims, they are settling the case.

From the class action settlement:

If you properly and timely submit a Settlement Claim Form, you will receive an electronic voucher that you may print and redeem at any Jimmy John's restaurant. If you receive a payment under this Settlement, you will also be releasing the "Released Claims" against Defendant (see next section for definition of Released Claims). If you wish to receive a payment under the Settlement, you must not "Opt Out" of the Settlement.

You can read the entire settlement documents here.
